The Harvard Business Review recently included tips on having difficult conversations in its feature, The Management Tip, including such things as eliminating delays, keeping things civil, and resisting the urge to make assumptions. FPMG, a performance management firm, agrees with those tips and has provided some more of its own.

Leaders are often placed in situations that require difficult conversations,” says Denise Federer, Ph.D., FPMG founder. “It’s quite common to put off these painful encounters because the outcome may create discomfort or you aren’t ready to deal with the consequences, but there is a better alternative: learn how to prepare for difficult conversations and take ‘tried and true’ actions while conducting them.”

FPMG notes that one of the most common types of difficult conversations, as identified by executives, is giving negative feedback to an employee. It’s perfectly normal to have irrational thoughts about the outcome—assuming it will be a catastrophe—and postpone the conversation until a “trigger moment” occurs. The problem with that approach, which is really no approach at all, is the risk of having an out-of-control encounter and outcome.

Federer suggests the key questions to ask during the first step (thinking) in the process of achieving a successful difficult conversation are as follows:


    What can I do differently?
    What am I willing to do differently?

“You must start by having a conversation with yourself,” Federer says. “Think about what’s happened, exploring truth, intention and blame—and remembering that everyone’s perception of the truth is their reality. Then, understand that the goal of having a difficult conversation is minimizing hurt, anger, and guilt, and allowing for as much dignity and learning to occur as possible. That means shelving judging behavior in favor of learning behavior, and moving from certainty to curiosity.”

During the second step (taking action) in the process of achieving a successful difficult conversation, FPMG says it’s important to use “I” messages and not assume knowledge of the other person’s feelings. Global generalizations like “you always” or “you never” shouldn’t be used and the focus should be on professionalism, being proactive rather than reactive and initiating difficult conversations in a timely manner.

Federer believes by engaging in the following four actionable behaviors prior to having a difficult conversation, it’s possible to set a positive tone for the interaction, foster a calm presence and provide closure to an uncomfortable situation.

    Be intentional in your behavior. Identify what your ideal outcome of the conversation would be prior to meeting with the individual.
    Clarify the issues objectively. Describe behavior and provide objective data; do not attack the person.
    Listen non-defensively. Be sure to hear the other person’s perspective.
    Generate a plan. Have an action plan in mind and follow-up with next steps in a timely manner.

“Also be aware that the best defense is a good offense—implementing rules, roles and expectations,” Federer says. “While you can never change another person’s behavior, people are forced to change in response to your behavior. The best example of this in the workplace is eliminating the need for difficult conversations by giving timely and honest feedback that positively affects employee behavior and helps them exceed expectations.”

A Powell man, Matthew Cordle, was facing charges of aggravated vehicular homicide earlier this year when made an unusual move: He confessed to the crime in a dramatic video and posted it on YouTube. The video, called “I Killed a Man,” went viral and has had more than 2 million views at this point. At trial, Cordle’s attorneys said the video demonstrated remorse, and asked for a lenient sentence, saying that the highly publicized and widely watched online video would lead many more to take responsibility for their actions (Associated Press, “Matthew Cordle’s lawyers ask for leniency,” October 17, 2013).

The tactic did not work. Cordle was sentenced to six years out of a maximum of eight, despite having no prior record (Ohio v. Cordle, Court of Common Pleas, Franklin County, Case No. 13CR-4732). He was also sentenced to an additional six months for drunk driving, his license was revoked for life and he was fined $ 1,075.

“When you’re facing criminal charges, it’s not the time to assuage a guilty conscience,” said Brian Joslyn, Columbus DUI lawyer. “Particularly for felony charges, like the ones in this case, the consequences are too severe.”

An OVI-related aggravated vehicular homicide is a second degree felony for a first offense, per Ohio Revised Code § 2903.06. It is punishable by up to eight years in prison and a fine up to $ 15,000. It also requires that a license be suspended for life.

In the prosecution’s sentencing memo to the court, in fact, the prosecutor actually cited the video as a reason to give a harsh sentence, writing that Cordle said he expected a long sentence and, therefore, he should get one. While not the maximum, a six-year sentence falls toward the greater end of that scope, and certainly does not reflect any leniency, Joslyn said.

“This is a fairly harsh punishment,” he continued. “There is no indication, from this sentence, that the judge took into account the idea that his video helped people or that he should get credit for taking responsibility. If anything, this stunt may have lead to a harsher punishment.”

Joslyn said the whole incident also serves as a reminder to those facing DUI charges or any type of criminal accusation: Do not post anything about the incident on social media, blogs or anywhere else.

“Many people are now posting virtually anything on social media,” Joslyn said. “It can really hurt a person’s case. As a DUI defense attorney, I can argue and get evidence like DUI tests thrown out, but if you tweet ‘Got pulled over after six Jager shots, #YOLO,’ it’s going to make my job considerably more difficult.”

Those facing potential DUI charges should refrain from posting anything at all on social media, blogs or elsewhere on the internet about the charge, the proceedings or the events leading up to the arrest, Joslyn said.

“You have a right to remain silent, and you should exercise that right on your Twitter, Facebook, Instagram, YouTube and Pinterest accounts, as well as blogs and any other places where people share their thoughts on the internet,” he said. “That includes any posts or comments proclaiming your innocence. Just stay silent and let your lawyer talk for you.”

Attendees included law enforcement agencies, financial institution auditors, information security consultants and more. More than 30 organizations attended the event. In addition to discussing how digital forensics should comply with local regulations and international standards, Nexusguard experts also took the stage to analyse actual security breaches and explain how investigation was conducted.

“Digital forensics is based on two key principles: 1) law enforcement must adhere to local adaptations of the UNCITRAL Model Law on Electronic Commerce (MLEC); and 2) law enforcement should comply with ISO/IEC 27037:2012 guidelines,” said Ronald Pong, Security Manager at Nexusguard Consulting. “Digital evidence must be collected through standardized processes to reduce the risk of it being tampered with and to preserve its value. It is not only important that the evidence holds up in the courtroom, it must also be preserved in a way that allows all the evidence to be fully investigated under time and budget constraints,” Pong continued.

“Most organizations believe that they are adequately protected, especially when their security is vetted by internal IT teams or external consultants. The reality, however, is that today’s attacks are difficult to detect and organizations don’t find out about the attacks until afterwards–but the organizations themselves may not even know why they were attacked or how they were affected,” said Tony Miu, Researcher, Nexusguard. “This is how analysis of cyber crimes normally begin.”

Cyber crime investigators must collect data from all devices, evaluate all explicit and implicit evidence, uncover key evidence, and put all the pieces together to reconstruct the crime and determine how the victim was affected. Only then can an effective defense strategy be drawn.

The purpose of the training sessions was to enhance digital forensic prowess for law enforcement agencies in the Asia-Pacific region, who are increasingly faced with high-tech crimes. The sessions covered multiple areas, including: data collection, information gathering and evidence collection. Nexusguard security experts Mandy Tupaz, Nash Tseung and Joe Lee explained how to accurately accurately collect, define and analyse data and discover information.

In addition, Miu analyzed real-world cases to assess the limitations of different network security equipment and propose effective security solutions. He said that the essence of the training sessions was to apply digital forensic techniques to analyse logs and gradually uncover key evidence.

Thousands of Pradaxa lawsuits (http://www.pradaxalawsuithelp.com/ ) continue to move forward in a federal multidistrict litigation underway in U.S. District Court, Southern District of Illinois, Bernstein Liebhard LLP reports. According to an Order issued on December 18, 2013, U.S. District Judge David R. Herndon is considering new sanction against defendant, Boehringer Ingelheim, and suggested that the company acted “unreasonably, negligently, willfully, and in bad faith,” in regards to certain evidence it now says it is unable to provide in accordance with an earlier directive from the Court. According to Judge Herndon’s Order, the sanctions will be determined once Bellwether Discovery has ended in the Pradaxa litigation, and could affect a number of aspects, including Boehringer Ingelheim’s ability to use certain affirmative defenses. “We are watching the Pradaxa litigation very closely, as we continue to investigate claims on behalf of alleged victims of the drug’s bleeding side effects. The final decision on these sanctions could have a significant impact on the outcome of Pradaxa lawsuits,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently offering free Pradaxa lawsuit evaluations to individuals who suffered serious internal bleeding while using this medication.

Pradaxa Lawsuits

Court documents indicate that just over 2,000 Pradaxa lawsuits have been filed in the Southern District of Illinois. All of the claims allege that Boehringer Ingelheim failed to provide adequate warnings regarding the risk of Pradaxa bleeding side effects, as well as the lack of an effective antidote for such an occurrence. The litigation’s first bellwether trial is scheduled to begin in August 2014.

According to court records, Judge Herndon has already sanctioned Boehringer Ingelheim once before for failing to preserve numerous documents sought by plaintiffs with cases pending in the proceeding. According to an Order dated December 9th, the company was fined $ 931,000 after Judge Herndon determined that the steps it had taken to preserve the documents in question were “grossly inadequate” and that the company had “made misrepresentations” regarding its efforts.

Pradaxa is a blood thinner that was brought to market in October 2010, and is used to prevent strokes in people with atrial fibrillation. According to Pradaxa lawsuits, the medication was marketed as a superior alternative to warfarin, a blood thinner that has been in use for decades.
